1. General Provisions
1.1. These Regulations on the Processing and Protection of Personal Data have been developed in accordance with the laws and regulations of Ukraine.
1.2. The purpose of these Regulations is to establish the procedures for collecting, recording, organizing, accumulating, storing, updating (revising, modifying), retrieving, using, and transferring (distributing, providing, granting access to), de-identification, blocking, deletion, and destruction of personal data processed on the website.
1.3. These Terms apply to all SUNTIME websites that contain a link to these Terms, regardless of how they are used or accessed, including access via mobile devices, in particular www. (hereinafter referred to as the “Website”).
1.4. By these Terms, the recipient of SUNTIME’s services is hereby notified and consents to the objective necessity—arising in the course of the Website’s operation and the receipt of SUNTIME’s services—to grant access to their personal data to software tools and third parties (partners or service providers). This access is provided solely for the purposes specified in this Policy. If the data subject does not agree, in whole or in part, to the terms of this Policy, use of the Website and its services must be immediately discontinued.
1.5. The following concepts, terms, and abbreviations are used in these Regulations: Personal data—any information relating directly or indirectly to an identified or identifiable natural person (data subject);Processing of personal data—any action (operation) or set of actions (operations) performed with or without the use of automated means on personal data, including collection, recording, organization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (dissemination, disclosure, access), anonymization, blocking, deletion, and destruction of personal data;Disclosure of personal data—actions aimed at revealing personal data to a specific person or a specific group of persons; Blocking of personal data—the temporary suspension of the processing of personal data (except in cases where processing is necessary to correct personal data);
Destruction of personal data—actions that render it impossible to restore the content of personal data in a personal data information system and/or that result in the destruction of physical media containing personal data;Anonymization of personal data—actions that make it impossible to identify a specific data subject without the use of additional information;Personal data information system – a collection of personal data contained in databases, along with the information technology and technical means that enable its processing.Cookies – a small piece of data sent by a web server and stored on a website visitor’s computer, which the web client or web browser sends back to the web server each time in an HTTPrequest whenever the user attempts to open a page on the corresponding website. IP address—a unique network address of a node in a computer network built using the IP protocol.
2. Collection and Processing of Personal Data
When determining the scope and content of the personal data being processed, the Company
«SANTAIM» operates in accordance with the Constitution of Ukraine, the Civil Code of Ukraine, the Labor Code of Ukraine, and Ukrainian legislation governing the protection of personal data.
2.1. The following are used to process personal data:
- Last name, first name, and patronymic;
- Contact phone number;
- Email address;
- Shipping address;
- Information About Payment Methods
2.2. Purpose of collecting and processing personal data:
- Order processing and product delivery;
- Ensuring high-quality customer service;
- Information about promotions, news, and special offers;
- Provision of advertising and marketing materials;
- Improving Our Service and Website
2.3. This website uses cookies and visitor data from web analytics services (IP address; cookie information; browser information; time of access to the website; URL of the page containing the ad unit; referrer (URL of the previous page)).This data is used to gather information about visitors’ actions on the website in order to improve its content, enhance the website’s functionality, and, as a result, create high-quality content and services for visitors.
2.4. A data subject may at any time change their browser settings so that all cookies are blocked or so that they are notified when cookies are sent. However, the data subject should understand that some features and services of the Project may not function properly as a result.
2.5. Personal data is processed without any time limit by any lawful means, including in personal data information systems—whether using automated means or not (mixed processing)—via the Internet.
2.6. All personal data is provided (collected) directly from the data subject.
2.7. The data subject independently decides whether to provide their personal data and consents to its processing freely, of their own volition, and in their own interest. Such consent also implies the data subject’s consent to the transfer of their personal data to third parties, to the processing of their personal data by third parties, and, in particular, to the cross-border transfer of data via the Internet (if such transfer is necessary for the effective provision of services).
2.8. Consent to the processing of personal data is provided when filling out special forms on the website while submitting an application to enter into the relevant service agreement or directly when paying for goods under that agreement. No separate written consent is required.
2.9. Consent to the processing of personal data may be withdrawn by the data subject at any time by contacting the «SANTAIM» customer support service. However, the company does not guarantee that, in the event of such a request, services that had not yet been provided at the time the withdrawal was received will be provided properly.
3. Rights and Obligations of the Parties Regarding the Processing of Personal Data
3.1. Data subjects are required to provide only accurate personal data and to promptly notify us of any changes to their personal data. However, «SANTAIM» does not verify the accuracy of such information and accepts it as provided by the customer. The risk of providing inaccurate personal data rests with the data subject. 3.2. Every data subject has the right: to receive complete information about their personal data and to have free access to their personal data, except in cases provided for by applicable law; to receive information regarding the processing of their personal data;to request that the company «SANTAIM» correct their personal data, to have it blocked or deleted if the personal data is incomplete, outdated, inaccurate, obtained unlawfully, or unnecessary for the stated purpose of processing, as well as to take measures provided for by law to protect their rights; and other rights provided for by the legislation of Ukraine.
3.3. The data subject has the right to independently make the necessary changes to the personal data provided during registration on the Website. In doing so, the data subject must ensure that «SANTIM» is notified of the changes in a timely manner by submitting a corresponding request to customer support.
3.4. A request from a data subject regarding their personal data is processed within 30 (thirty) calendar days from the date of such request, unless a different timeframe is specified in these Regulations. All correspondence regarding such requests shall be conducted through the support service by sending emails to the data subject.
4. Transfer of Personal Data
4.1. For the purpose of effectively processing personal data, «SANTIME» and the data subject may enter into an agreement whereby «SANTIME» is authorized to delegate the processing of personal data to other legal entities or individuals on the basis of a contract (hereinafter referred to as the «Project Assignment»), including through cross-border data transfers via the Internet. In such cases, the data subject’s separate consent for such transfers is not required. Any person processing personal data on behalf of “SANTAIM” must comply with the principles and rules for the processing of personal data set forth in Ukrainian legislation regarding personal data.
4.2. The transfer of personal data of parties with whom SANTAIM interacts is carried out solely for the proper fulfillment of obligations under the concluded contracts (agreements), within the framework of which SANTAIM and the aforementioned parties interact.
5. STORAGE OF PERSONAL DATA 5.1. Personal data is stored electronically in the relevant personal data information systems, which are located in databases within Ukraine.
5.2. Personal data is stored with restricted access, including through the establishment of appropriate access levels.
5.3. The storage of data subjects’ personal data must be carried out in a manner that prevents its loss or unauthorized use.
4.4. Personal data contained in various electronic databases and processed for different purposes is stored separately.
6. Protection of Personal Data
6.1. . Data controllers, data processors, and third parties are required to ensure that such data is protected against accidental loss or destruction, as well as against unlawful processing, including unlawful destruction of or access to personal data.
6.2. Individual entrepreneurs are personally responsible for ensuring the protection of the personal data they hold, in accordance with the requirements of the law.
7. Oversight of Personal Data Protection
7.1. The following authorities are responsible for monitoring compliance with personal data protection laws within the scope of their statutory powers:
- Authorized Representative;
- courts.
8. Additional Terms and Conditions
8.1. SANTAIM reserves the right to make changes to this Privacy Policy without the consent of the data subjects.
8.2. The new Privacy Policy takes effect upon its publication on the website, unless otherwise specified in the revised Privacy Policy.
